That doesn't quite look like a 20" barrel or rifle length gas system and what's down there definitely isn't a fixed stock, so it's not an M16. But it isn't an M4 either, the barrel doesn't have the M203 notch and it looks more like 16" than 14.5". Most probably a civilian 16" AR-15.
