In that case, it would probably count as improperly tagged according to a strict interpretation of the rules. After all, the whole reason for the loli/shota tags needing privileged accounts is because of the advertisers, so having them mistagged risks loosing the advertising that helps keep the site alive.

Depends on how sexually charged and/or "crude" it is. A playful topless kid, yeah, that's innocent enough. A pissing nude fountain? Yeah, a bit less overlook-able.
