Adding to this, Nasu breaks and changes rules all the time, along with other people writing Fate. They can invent a reason for anyone to be a servant if they feel like it.
Rules has never been holy in the Fate franchise. Right from the FSN days rules like "Assassin = Hassan only" or "more famous = power boost" are introduced explicitly so they can be broken. Every installment ever since has had its share of giving middle fingers to pre-established rules, or new rules itself introduced.
